3D Print Sales Terms & Conditions

1. Introduction

RUM-Gaming ("we," "our," or "us") is a 501(c)(3) nonprofit organization based in Bartlesville, Oklahoma. In addition to our free 3D-print giveaway program, we offer certain 3D-printed items for sale to the general public. These Terms of Sale ("Terms") govern all purchases made through RUM-Gaming directly or through any affiliated sales channels.

By placing an order, you (the "Customer") agree to be bound by these Terms.

2. Product Description & Use

  1. Nature of Goods. All 3D-printed items are hobby-grade and are not certified for structural, safety-critical, medical, or food-contact use. Items are intended for decorative, collectible, or non-functional use unless explicitly stated otherwise.

  2. Variations. Due to the nature of 3D printing, each item is unique. Minor imperfections, visible layer lines, and surface artifacts are normal and not considered defects.

  3. No Custom Orders. Customization may be available only at our discretion and must be approved prior to purchase.

3. Licensing & Intellectual Property

  1. Original Designs. Items sold are either original designs, open-license models, or properly licensed reproductions.

  2. Licensed Models. For items based on copyrighted or trademarked content:

    • We may require you to verify you hold a valid license to the model, or

    • We may include licensing fees in the purchase price, or

    • We may decline to sell the item, or

    • We may choose to purchase and maintain the license ourselves for future production at our discretion.

  3. Restrictions. No sale grants the Customer any rights to reproduce or resell the item or underlying model.

4. Pricing & Payment

  1. Prices. All prices are listed in U.S. dollars and are subject to change without notice.

  2. Taxes. Applicable sales tax will be added based on the shipping destination and current tax laws.

  3. Payment Methods. We accept major credit/debit cards and other forms of payment as listed at checkout. Orders must be paid in full before processing.

5. Shipping & Delivery

  1. Shipping Area. Orders are shipped only within the United States and its territories.

  2. Processing Time. Items typically ship within 5–10 business days of payment, but times may vary.

  3. Risk of Loss. Title and risk transfer upon delivery to the carrier. If an item is received damaged, the Customer must notify us within 10 calendar days so we may file an insurance claim. Late notifications may forfeit eligibility for replacement.

  4. Delivery Issues. We are not responsible for delays or losses caused by the shipping carrier but may choose to resend items at our discretion.

6. Returns & Refunds

  1. All Sales Final. Due to the made-to-order nature of our products, all sales are final. Returns or exchanges are not accepted except in cases of:

    • Significant damage during shipment (with timely notification);

    • Wrong item received.

  2. Replacement Only. Refunds are not guaranteed. If eligible, replacements may be offered at our discretion.

7. Prohibited Orders

We reserve the right to reject or cancel any order for:

  • Items intended for illegal, harmful, or malicious use;

  • Any file that violates our standards on weapons, drugs, or hate-related content;

  • Any reason inconsistent with our nonprofit mission or values.

8. Limitation of Liability

  1. As-Is Basis. Products are provided "as is" without warranties of any kind.

  2. Liability Cap. RUM-Gaming's total liability shall not exceed the amount paid by the Customer for the specific item.

  3. Indemnification. Customer agrees to hold RUM-Gaming harmless from any claims related to misuse or unauthorized modification of the product.

9. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Washington County, Oklahoma.

10. Modifications

We may update or modify these Terms at any time. Continued purchases after changes constitute acceptance of the new Terms.

3D Print Giveaway Terms & Conditions

1. Introduction

The Regulators of Unchecked Misfortune Gaming ("RUM‑Gaming," "we," "our," or "us") is a U.S.‑based 501(c)(3) nonprofit organization whose mission is to support veterans through the power of gaming and technology. As part of our outreach, we periodically provide free, single‑run 3‑dimensional ("3D") printed objects (the "Print(s)") to qualifying veterans (the "Participant(s)") at no cost. These Terms & Conditions (the "Terms") govern all requests, selections, production, and distribution of Prints through the RUM‑Gaming 3D‑Print Giveaway Program (the "Program").

Participation in the Program constitutes the Participant’s full and unconditional agreement to, and acceptance of, these Terms.

2. Eligibility

  1. Veteran Status. Participants must be honorably discharged or current U.S. military service members and able to provide verification upon request (e.g., DD‑214, VA ID, active‑duty CAC).

  2. Age. Participants must be at least 18 years of age.

  3. Residency. Prints can only be shipped to valid mailing addresses within the 50 United States, APO/FPO, or U.S. territories where lawful.

3. How to Request a Print

  1. Submission. Eligible Participants may submit one (1) printable 3D model file (STL, 3MF, or OBJ) or a direct download link via the online form or email address specified by RUM‑Gaming. Multiple submissions or resubmissions may be disqualified at our sole discretion.

  2. Selection. Due to limited resources, not all requests will be fulfilled. Recipients are chosen in RUM‑Gaming’s sole discretion, based on available materials, printer capacity, and alignment with our mission.

  3. Proof of Rights. By submitting a file, the Participant represents and warrants that they own or validly license all intellectual‑property ("IP") rights necessary for RUM‑Gaming to print and distribute the requested model.

4. Prohibited Content & Items We Will Not Print

RUM‑Gaming will not print any file that, in our sole judgment, falls within one (or more) of the following categories. The examples are illustrative, not exhaustive:

Weapons & Parts: Firearms or firearm components, suppressors, high‑capacity magazines, ammunition, blades, batons, tasers, explosive devices, or functional replicas thereof.

Drugs & Paraphernalia: Illegal drugs, controlled‑substance containers, bongs, pipes, dab tools, pill presses, or concealment devices designed for illicit substances.

Illegal or Harmful Objects: Lock‑picking tools, bump keys, counterfeit credit‑card molds, or any item intended to facilitate wrongdoing.

Hate, Obscene, or Harassing Content: Models depicting hateful, extremist, or pornographic themes, or that target a protected class.

Licensed IP Without Proof: Characters, logos, game assets, or designs protected by copyright, trademark, or patent unless Participant provides written authorization or proof of license.

Other: Anything RUM‑Gaming deems inconsistent with our charitable purpose or applicable law.

We reserve the right to refuse any file for any reason and without explanation.

5. Licensing & Intellectual‑Property Compliance

  1. Participant Responsibility. The Participant bears full responsibility for ensuring the requested model does not infringe third‑party IP rights.

  2. Licensed Files. If a model requires a paid license, we may (a) request proof of purchase; (b) require that the Participant supply the production‑ready file; (c) decline the request; or (d) choose to assume the cost of the license and maintain it for future qualifying prints at our discretion.

  3. Retention & Deletion. We delete or archive submitted files after 30 days unless otherwise required by law or internal audit.

6. Print Quality, Tolerances & Intended Use

  1. Best‑Effort Basis. Prints are produced on a best‑effort basis using hobby‑/prosumer‑grade FDM or resin printers. No single Print is guaranteed to meet exact dimensional, mechanical, or cosmetic specifications.

  2. Post‑Processing. Surface finish may include visible layer lines, support‑removal marks, or minor artifacts. Unless expressly stated, sanding, priming, painting, or assembly is not included.

  3. Non‑Critical Use. Prints are not certified for load‑bearing, safety‑critical, medical, or food‑contact applications. Use them at your own risk.

7. Shipping & Delivery

  1. Cost. Standard domestic shipping (ground or USPS) is provided at no cost to the Participant. Expedited shipping is not available.

  2. Title & Risk. Title and risk of loss pass to the Participant upon deposit with the carrier. We are not responsible for delays, damage, or loss during transit, but may, at our discretion, reprint or replace damaged items when feasible. If a Print is received damaged, the Participant must notify RUM‑Gaming within 10 calendar days of receipt so that we may initiate a claim with the shipping carrier. Failure to notify within this timeframe may forfeit eligibility for a reprint.

  3. Customs. Requests requiring export outside U.S. jurisdiction will be declined.

8. Publicity & Media Release

By accepting a Print, the Participant grants RUM‑Gaming permission to photograph the finished piece and share non‑confidential images or testimonials on our website, social media, or fundraising materials, unless the Participant opts out in writing before shipment.

9. Modifications, Suspension, or Termination

RUM‑Gaming reserves the right to modify, pause, or terminate the Program—or these Terms—at any time, for any reason, without prior notice, to the fullest extent permitted by law.

10. Limitation of Liability & Indemnification

  1. No Warranty. Prints and related services are provided “as is” without warranties of any kind, express or implied.

  2. Liability Cap. To the maximum extent permitted by law, RUM‑Gaming’s total liability arising out of the Program shall not exceed USD $25.

  3. Indemnity. Participants agree to indemnify, defend, and hold harmless RUM‑Gaming, its officers, directors, volunteers, and partners from any claim arising out of or related to (a) the submitted file; (b) Participant’s use of the Print; or (c) breach of these Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict‑of‑laws principles. Any dispute arising hereunder shall be resolved exclusively in the state or federal courts located in or nearest to Washington County, Oklahoma, and the Participant consents to the jurisdiction of such courts.

12. Entire Agreement & Severability

These Terms constitute the entire agreement between RUM‑Gaming and the Participant concerning the Program and supersede all prior communications. If any provision is held unlawful or unenforceable, the remaining provisions will remain in full force and effect.

13. Acceptance

By submitting a 3D‑print request or accepting a Print, the Participant acknowledges they have read, understood, and agree to be bound by these Terms.
